Release of Liability/Assumption of Risks/Disclaimers/Acknowledgements/Indemnifications

For purposes of this document, “Trainer” means Find Fitness With Sharon/Sharon Piotrowski and including but not limited to Trainer’s affiliates, employees or agents, representatives, successors and assigns. “You” represents the purchaser, viewer and any and all affiliates of said person including but not limited to employees or agents, representatives, successors and assigns, family and/or friends.The “plan” is the 30 Day Fitness Plan/Secrets of Weight Loss E-Book and is included in this release, disclaimer, assumption of risk, acknowledgements and indemnifications. 


Assumption of Risk: By purchasing plans, merchandise and/or participating in the exercises and/or routines presenting in the website or YouTube or other social media you do so at your own assumption of risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in the physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility or using any equipment. Your assumption of risk also includes injuries or damages arising out of the negligence of the Trainer whether active or passive. Your assumption of risk includes, but is not limited to, your use of any exercise equipment (mechanical or otherwise), or other areas, sidewalks, stairs, chairs or other general areas of any facilities, your home or any equipment, whether yours or someone else’s. You agree you are voluntarily participating in the any activities presented to you by the Trainer and assume all risk of injury, illness, damage or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Trainer or otherwise.  


RELEASE: You agree on behalf of yourself (and all your personal representatives including but not limited to your heirs, executors or agents) to release and discharge Trainer (including but not limited to Trainer’s affiliates, employees or agents) from any and all claims or causes of action (known or unknown) arising out of the negligence of the Trainer, whether active or passive. This waiver and release of liability includes, without limitations, injuries which may occur as a result of (a) your use of any exercise equipment or facilities, whether your own home or not which may malfunction or break, (b) improper maintenance of any exercise equipment, premises or facilities and (c) negligent instruction or supervision, including but not limited to personal training.


INDEMNIFICATION: By viewing or purchasing any products from the Trainer you hereby agree to indemnify and hold harmless Trainer from any loss, liability, damage or cost Trainer may incur due to the provision of Trainer providing said exercises presented to the public or by purchase. 


ACKNOWLEDGEMENT: You expressly agree that the foregoing release, waiver, assumption of risk and indemnity agreement is intended to be as broad and inclusive as permittee by the law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. You acknowledge that Trainer offers a service encompassing the entire recreational and/or fitness spectrum. This release is not intended as an attempted release of claims of gross negligence or intentional acts. By reading this Disclaimer you release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. You are aware and agree that by reading this waiver and release, you are giving up your right to bring a legal action or assert a claim against Trainer for Trainer’ s negligence or for any defective product used while viewing training from trainer. You have read said waiver and release and further agree that no oral representations, statements or inducement apart from the foregoing said agreement have been made. 

This, like any exercise(s) is inherently dangerous and can result in personal injury. An injury sustained from proper or improper use of the exercise(s) shown in this video is solely the responsibility of the exerciser (you). The Trainer disclaims any liability from injury(s) sustained from the use of the exercise(s) shown in the video, presented in materials purchased or offered and suggest that your consult your professional healthcare provider before attempting any exercise or exercise program.


DISCLAIMER: You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs.
